By
making a reservation at Hand Hollow Haven, Guest agrees that Guest
and Guest’s visitors will abide by these Rules and Regulations, as
well as any other Rules and Regulations posted in the House Manual or
on the property.
1.
Use only
wired
connections for phones and devices!
When
in use, always place your cell phones and wireless
devices in Airplane Mode and connect to
one of the wired ethernet connections.

2. Please refrain from using Remote Vehicle Starters / Hotspots while you are at Hand Hollow Haven. The burst of RF radiation harms you and your hosts.

3. Pets No pets are permitted at Hand Hollow Haven at any time, not even visiting pets, inside or outside. Hand Hollow Haven does not accept pets due to the proximity of Hand Hollow State Forest and the abundance of wildlife and their young which frequent the Haven, including deer, turkeys, rabbits, and others.
Besides,
some
of our guests may have pet allergies.

4. Off Limit Areas
The pond area is off limits. There is No Swimming in the pond.

5. No parties or events allowed
Only those in the Guest party set forth in the Rental Agreement may stay overnight on the property. The maximum capacity of Haven House is (6) people, including four (4) overnight guests.

6. Observance of Quiet Time is a condition of your stay. Avoid making loud noise during Quiet Time, between 8 p.m. and 9 a.m..

7. No Smoking: Smoking is NOT allowed on the property, either inside OR outside.

8. Alcoholic Beverages & Drugs: Guest agrees that there will be no illegal activities on the premises, including but not limited to: possession, serving or consumption of alcoholic beverages by anyone under the age of 21; or the possession or use of any illegal drugs. Additionally, Guest accepts full responsibility and liability and hereby indemnifies Owner and/or Owner’s agents for anything that happens as a result of Guest and / or Guest’s visitors partaking of any alcoholic beverages or drugs on the property.

9. Fireworks: Fireworks are not permitted at Haven House nor anywhere at Hand Hollow Haven at any time.

10. Eating areas.
Please don’t eat or drink in the bedrooms. Enjoy your meal in the Dining Room next to the Kitchen.

11. Turn it off.
When you leave the house, make sure to turn off the stove, the lights, and any electronics.

12. Close and lock.
When you leave the house, don’t forget to close and lock the windows. Double-check that you have locked the door.

13. Dishes and Garbage
Please wash the dishes and throw out the garbage before checking-out and leaving at the end of your stay. You will find receptacles in the driveway, by the garage door. Please place all trash bags into the beige garbage can and loose recyclables into the gray recycle bin.

14. Promptly report any damage and / or breakage.
Damages exceeding the Waivo® Damage Protection amount must be paid by guests and will be reported to Airbnb.

This
guide contains information about Hand Hollow Haven, the area, and
tips to help you enjoy your stay.
Check-In: Access to the property will be available at 4 p.m. Guest will be given a code for the key pad on the door, for private access to Haven House. The code will be provided to you just prior to check-in.
Housekeeping: Linens and bath towels are included in the rental rate, along with a complementary welcome kit with travel sized soap, shampoo, toothpaste, and toothbrush. Mid-Stay and Extended Stay cleaning service can be arranged upon request for an additional guest cleaning fee.
Weather: Hand Hollow Haven is located in snow country. We love the snow but local roads can be snow covered. The driveway is plowed, but Guest will be responsible for shoveling the steps and shoveling out their car should Hand Hollow Haven receive significant snow during Guest’s stay. A shovel and sand / ice melt will be provided.
We cannot refund anything due to road conditions. Travel insurance is recommended.
Children: Hand Hollow Haven is family friendly and welcomes well-behaved children who are respectful of the property. Parents hereby agree to supervise their children both indoors and outdoors.
Plumbing: We have a septic system. The system is very effective; however, it will clog if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. Do not pour grease or or large food particles down the Kitchen or Bathroom sinks.
Please
use only the Scott Septic
Safe®
toilet tissue that is provided. If there is a clog in the system,
Guest will be charged damages accordingly.
Parking: Haven House offers a private driveway for up to 2 cars.

SHORT
TERM RENTAL AGREEMENT
This
Short Term Rental Agreement (the “Agreement”) is made by and
between HAND HOLLOW HAVEN, LLC, Operators of Haven House and Hand
Hollow Haven ("Owners
Agents"), and GUEST,
(“Guest") as of the electronic acceptance date of this
Agreement. For good and valuable consideration, the sufficiency of
which is acknowledged, the parties hereby agree as follows:
1. Property: The property is located at mailing address 215 Hand Hollow Road / County Route 34, East Chatham, NY, 12060, in the Town of New Lebanon, New York. The property is a three-bedroom house with one bathroom. It is furnished and includes household appliances, furnishings, decorations, artwork, linens, towels, kitchenware, audio / video equipment, computer equipment, and personal property.
2. Rental Group / Maximum Occupancy: The rental group shall be limited to the number listed on the rental reservation. The maximum number of overnight guests is limited to 4 persons unless a specific written exemption has been made by Owner. An additional guest fee of $30 per guest per night will be charged.
At
all times during said rental period, Guest agrees to have no more
than the allowed number of guests for occupancy. (This includes
children.) If more than the stated number of guests are found to be
occupying the unit without prior written permission, Owner has the
right to terminate this contract and Guest will forfeit all monies
paid, including rent, cleaning, and deposits.

3. Term of the Lease: The rental period begins at 4 p.m. on the dates in the reservation and will end at 11 a.m. on the check-out date. All guests must leave the property at this time.

4. Rental Rules: Guest agrees to abide by the Rental Rules attached as the first part of this Rental Agreement and to abide by the Rules in the House Manual provided upon booking, at all times while at the property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. Should Guest violate these rules, Owner reserves the right to cancel this rental immediately with no refund due to Guest.

5. Noise: Guest understands and agrees that they, and all members of their rental party will be respectful to our neighbors, including driving slowly on the road to the property, not creating any noise (including music) which the neighbors can hear, especially in the evening and during the night. Observance of Quiet Time is a condition of your stay. Avoid making loud noise during Quiet Time, between 8 p.m. and 9 a.m.. Any violation of this rental agreement and Guest will be required to leave immediately, with no refund for any unused rental time.

6. Fees and Payments
Rental Rate and Fees: The rental rate shall be as stated on the rental site. Additional guests may be permitted, only with a specific written exemption has been made by Owner, at a rate of $30 per guest per night.
Cleaning Fee: The cleaning fee shall be as stated on the rental site. The fee is per stay.
Damage Protection Fee: $40.00 per stay.
There is no Security Deposit due. (as detailed in #9 below)

7. Cancellation Policies:
Note: Each OTA site listing Hand Hollow Haven utilizes it's own cancellation policies. We strive to maintain consistent policies across channels.
Lodgify - Direct Booking: 100% of paid prepayments refundable when canceled 30 days before arrival or earlier. 50% of paid prepayments refundable when canceled 7 days before arrival or earlier. 0% refundable if canceled thereafter.
Airbnb: 100% of paid prepayments refundable when canceled 30 days before arrival or earlier. 50% of paid prepayments refundable when canceled 7 days before arrival or earlier. 0% refundable if canceled after.
Booking.com: 100% of paid prepayments refundable when canceled 30 days before arrival or earlier. 50% of paid prepayments refundable when canceled 0 days before arrival or earlier. 0% refundable if canceled after.
Vrbo: 100% of paid prepayments refundable when canceled 30 days before arrival or earlier. 50% of paid prepayments refundable when canceled 14 days before arrival or earlier. 0% refundable if canceled after.
Rental
Insurance (as detailed in #8 below) is recommended.

8. Travel and Vacation Rental Insurance: Life is unpredictable, therefore, we encourage all guests to purchase travel insurance. If purchased by you, this insurance reimburses you for prepaid non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. This can include but is not limited to sudden illness, death in the family, or property unavailability due to Force Majeure. It is strongly recommended that Guest purchase this valuable protection; however Guest has the option to decline to purchase travel insurance. You can purchase Travel Insurance from many providers.
Owner
is not responsible for the relocation of Guest should the house
become non-habitable due to acts of God, such as wildfire, floods,
tornadoes, earthquakes and natural disasters, and Owner is not liable
for the costs of finding an alternative accommodation or for damages
because alternative accommodation cannot be found. We recommend the
purchase of trip insurance that would protect Guest from monetary
loss from such an event.

Although
rare, accidental damage from guests does happen. Traditionally, this
was managed via a security deposit or vacation rental damage
insurance purchased by the guest. Both are cumbersome and often have
big limitations in protection.

the damage protection, accidental damage from a guest is covered
unless it's specifically excluded such as, but not limited to, normal
wear and tear, mechanical breakdown, or odor.

10. Condition of Property: Guest shall return the premises in the same condition as received. As a part of the rental agreement, Guest will pay a Cleaning fee which includes normal “turn” cleaning. Guest agrees they will be responsible for excessive additional cleaning if needed, and hereby agrees to have excessive cleaning performed at Owner’s sole discretion.
Guest
promises to keep the property and all furnishings in good order and
to leave the property in the same (or better) condition than when it
was rented.
All
items, furniture, et cetera, shall be in the same places as where
guests found them upon Check-In.
Guest
promises to only use appliances and amenities of the vacation rental
for their intended uses.

11. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
12. No Assignment or Subletting: This Agreement shall not be assigned, nor the premises sublet without the prior written consent of the Owner. Guest acknowledges that they will personally occupy the property for the entire lease or rental period and will not sublet any portion of the property. Violation of these terms shall give Owner the right to immediately evict Guest and terminate this Agreement, and Guest will forfeit any right of return of any monies paid to date including any security deposit.
13. Indemnification:
Owner
and / or Owner's Agent are not responsible for the loss of personal
belongings or valuables of the Guest.
The
Guest understands and agrees that the Owner and / or Owner's Agent
Hand Hollow Haven, LLC are not responsible for any accidents,
injuries or illness that occurs while on the premises or its
facilities. Guest agrees to indemnify Owner and Owner’s Agent and
save Owner and Owner’s Agent from and against any and all claims,
actions, damages, liabilities and expenses, including reasonable
attorney’s fees in connection with the loss of life, personal
injury and / or damage to the property arising from or out of any
occurrence in, upon, or about the premises, occasioned by an act or
omission by Owner, Owner’s Agent, Guest or other occupants.
By
accepting this reservation, it is agreed that all guests are
expressly assuming the risk of any harm arising from their use of the
premises or others whom they invite to use the premises. If all
guest on this reservation do not personally sign this waiver of
liability, then the primary renter accepts liability for all guests
and hereby waives any Owner or Owner's Agent liability on their
behalf.

14. THE SUPERVISION AND SAFETY OF ALL CHILDREN ARE THE DIRECT RESPONSIBILITY OF GUEST OR PARENTS, OR CARETAKERS OF ANY CHILDREN ON THE PREMISES, including but not limited to decks, stairs, yard, the Pond, and any and all other activities on the premises.

(a) All children will be attended by an adult when at Haven House and on the property of Hand Hollow Haven.
(b) No children will ever be permitted anywhere near the Pond.
(c) No one will jump off of the deck.

15. Entire Agreement: This document, titled "Rental Agreement and Rules", constitutes the entire agreement between the parties. No oral statements shall be binding. This Agreement may only be amended by a written document duly executed by all parties. It is the intention of the parties that if any portion of this Agreement is invalid for any reason, such invalidity shall not void the remainder of the Rental Agreement.
16.
Disputes and Jurisdictions: This agreement shall be
interpreted under the laws of the State of New York. Any dispute
under this Agreement shall be resolved in the County of Columbia,
State of New York. All disputes, controversies or claims arising out
of or relating to this contract shall be submitted to mediation or
arbitration in the County of Columbia. If either party brings an
Action to enforce its rights under this agreement, the prevailing
party may recover its expenses (including reasonable attorneys' fees)
incurred in connection with the Action and any appeal from the losing
party.
17. GUEST ACKNOWLEDGES THAT THEY HAVE REVIEWED AND UNDERSTAND THE TERMS OF THIS SHORT TERM RENTAL AGREEMENT, along with the introductory section "About Haven House" and the Haven House Rules, and agrees to be bound by them.

18. Guest and Owner / Owner's Agent acknowledge that electronic acceptance of this Agreement is legally binding acceptance of all terms and conditions, the same as if Guest had actually executed the Agreement in person.
